1. Introduction

Welcome to One Asset Market (“OAM”, “the Platform”, “we”, “our”, or “us”).

By accessing, browsing, registering on, listing products or services, purchasing, advertising, or otherwise using the Platform, you agree to comply with these Terms and Conditions.

If you do not agree to these Terms, you must discontinue use of the Platform immediately.

2. Purpose of the Platform

OAM provides a digital marketplace and business platform where individuals, businesses, organisations, and service providers may promote, advertise, offer, buy, sell, lease, exchange, or market approved products and services.

OAM reserves the right to determine, at its sole discretion, what products, services, listings, advertisements, content, and activities may be displayed on the Platform.

3. Eligibility

Users must:

  • Be at least 18 years of age or have legal authority to enter into agreements.
  • Provide accurate and truthful information.
  • Maintain current account information.
  • Comply with all applicable laws and regulations.

OAM may request identity verification at any time.

4. User Responsibilities

Users are solely responsible for:

  • The content they upload.
  • Products and services they advertise.
  • Information contained within listings.
  • Images, videos, documents, trademarks, and intellectual property used.
  • Communications conducted through the Platform.

Users warrant that all information submitted is accurate, lawful, and not misleading.

5. Content Standards

All content published on OAM must be professional, lawful, accurate, respectful, and suitable for a broad public audience.

The following content is strictly prohibited:

  • Pornographic, sexually explicit, or adult-oriented content.
  • Content that exploits, endangers, or targets minors.
  • Offensive, abusive, discriminatory, hateful, threatening, or harassing material.
  • Graphic violence or disturbing imagery.
  • False, misleading, deceptive, or fraudulent information.
  • Content promoting illegal activities.
  • Spam, mass solicitation, or unsolicited advertising.
  • Content designed to deceive users.
  • Impersonation of individuals, organisations, or brands.
  • Content that infringes intellectual property rights.
  • Malicious software, harmful code, or suspicious links.
  • Material that may reasonably damage the reputation, integrity, or credibility of OAM.

OAM maintains a family-friendly, professional marketplace environment and reserves the right to remove any content that does not align with these standards.

6. Products and Services

All products and services offered on OAM must:

  • Be lawful.
  • Be accurately represented.
  • Be available for legitimate commercial purposes.
  • Comply with applicable legislation.
  • Meet reasonable standards of quality and safety.

OAM may reject, suspend, edit, remove, or prohibit any listing at its sole discretion.

7. OAM’s Right to Remove Content

OAM reserves the unrestricted right to:

  • Remove listings.
  • Remove content.
  • Suspend accounts.
  • Restrict platform access.
  • Disable advertisements.
  • Request supporting documentation.
  • Permanently terminate accounts.

Such action may be taken without prior notice where OAM believes content, conduct, or activity may:

  • Harm users.
  • Harm the reputation of the Platform.
  • Breach these Terms.
  • Breach any applicable law.
  • Create legal, operational, or reputational risk.

OAM shall not be liable for losses resulting from such actions.

8. Intellectual Property

Users remain responsible for all content they upload.

By submitting content to OAM, users warrant that they possess all necessary rights, licences, permissions, and authority to publish such content.

Users indemnify OAM against any intellectual property disputes, copyright claims, trademark claims, or related legal actions arising from their content.

9. Transactions and Listings

OAM operates as a marketplace and facilitation platform.

Unless expressly stated otherwise:

  • OAM is not the manufacturer.
  • OAM is not the owner of listed products.
  • OAM is not the employer of service providers.
  • OAM is not a party to agreements concluded between users.

Users transact at their own discretion and risk.

10. Limitation of Liability

To the fullest extent permitted by law, OAM shall not be liable for:

  • Listing inaccuracies.
  • Product defects.
  • Service failures.
  • Delivery delays.
  • User misconduct.
  • Fraud committed by third parties.
  • Indirect or consequential losses.

11. Indemnity

Users agree to indemnify and hold harmless OAM, its directors, employees, partners, contractors, and affiliates against any claim, loss, liability, damage, cost, or legal expense arising from:

  • User conduct.
  • Uploaded content.
  • Products or services offered.
  • Breach of these Terms.
  • Violation of any law or third-party rights.

12. Suspension and Termination

OAM may suspend or terminate any account at its sole discretion where a user:

  • Breaches these Terms.
  • Uploads prohibited content.
  • Misuses the Platform.
  • Engages in fraudulent activity.
  • Acts in a manner inconsistent with the values and standards of OAM.

13. Amendments

OAM reserves the right to amend these Terms at any time.

Updated Terms shall become effective upon publication on the Platform.

14. Governing Law

These Terms shall be governed by the laws of the Republic of South Africa.

Any disputes shall be subject to the jurisdiction of the South African courts.
